TERMS AND CONDITIONS
These are the terms and conditions (Terms), including the conditions of entry, which apply to the trade promotion (Promotion) being Midasshoes.com.au is a website owned by Cinori Shoes Pty Ltd (ABN 58 075 876 425) ("Licensor"). The Licensor grants Australian Footwear Pty Ltd (ABN 40 168 259 210) ("Licensee") to operate the website and trade as Midas. Both Licensor and Licensee are subsidiaries within Munro Footwear Group Pty Ltd (ABN 59 614 250 501) known together with its directors, employees, and agents as "We", "Our" or "Us".
By entering the Promotion, each entrant accepts these Terms and agrees that the Promotion will be conducted in accordance with, and the entrants’ rights will be governed by these terms.
Eligibility
The Promotion commences at 09:00 am AEST Wednesday 20th September 2023 and closes at 23:59 pm AEST Wednesday 18th October 2023 (Promotion Period). Entries will not be valid unless made during the Promotion Period.
The Promotion is open to NSW, QLD, SA, NT, ACT, TAS, WA and VIC residents aged 18 and over only. Travel from VIC will not be provided. Travel is only included from the territory or state's major capital city airport.
Entry is free and is open to residents of Australia, who enter the Promotion in accordance with the conditions of entry below. Entrants must be aged 18 years or older. Employees (and their immediate family and/or those living in the same household) of the Promoter, and its respective affiliates, subsidiaries, agencies and suppliers associated with the Promotor are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
How to Enter
To enter, individuals entering (Entrants) must complete the entry form during the Promotional Period as hosted on the Promoter’s website via https://www.midasshoes.com.au/mfwcomp
By entering the promotion, Entrants agree to be subscribed to the Midas Shoes email database using the email provided in their entry form. Entrants can unsubscribe at any time, by contacting Midas Shoes customer service or by using the unsubscribe link in the footer of all email communications.
Determining and Notifying the Winner
Selection of the winner will take place at the office of the Promoter at 28 Victoria Crescent, Abbotsford, VIC 3067 on Thursday 19th October 2023 at 09:00 am AEST
This competition will run as a Game of Chance. The winner will be selected through random electronic selection. The Promoter’s decision is final, and no correspondence will be entered into.
The winner will be notified via email or phone call, on Thursday 19th October 2023 at 10:00am AEDT
If for any reason a winner does not acknowledge, accept, and claim their Prize by 17:00 pm AEST on Monday 23rd October 2023, the Prize will be forfeited, and another winner selected. The Promoter will have no liability for a winner's failure to receive notices due to winner’s spam settings, their not checking Instagram DMs, junk email or other security settings or for a winner’s provision of incorrect or otherwise non-functioning contact information.
The Promotor reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these Terms. The promoter reserves the right to alter, extend, delete, or change the promotion without notice.
The Prize
There will be 1 prize winner. The prize is valued at up to $5,000 AUD and comprises:
· Return economy flights from the winner's nearest capital city to Melbourne for the winner and one guest. (Valued at up to $2000AUD) valid for travel to Melbourne on Sunday 29th October 2023 and return flights back to the winner's nearest capital city on Monday 30th October 2023.
· Private return airport/hotel transfers in Melbourne. (Valued at $200AUD)
· Luxurious overnight stay (1 night) at the new Le Méridien Melbourne on Sunday 29th October 2023. (Valued at $600AUD)

· Midas shoe fitting and complimentary pair of shoes at our Midas The Strand Boutique for the winner and their guest (Valued at $500 AUD, shared between two people)

Prize terms and conditions:
● Anything not listed in the above prize details and value is not part of the prizing.
● Prizing cannot be negotiated or traded in for something else.
The following conditions are applicable to the prize:
· Package is based on 2 people sharing a room (King or Twin configuration available).
· Midas shoe fitting and complimentary pair of shoes for winner & their guest to a maximum value of $500 total to be redeemed at Midas The Strand and in one single transaction. If winner or winner’s guest is male this part of the prize is still available and can be swapped for an online Midas voucher.
· Dates of travel must be Sunday 29th October 2023 – Monday 30th October 2023.
· The prize is non-refundable and non-transferable.
· Winner will be required to produce credit card upon check in at Le Méridien Melbourne for any incidentals. This is mandatory.
· Winner and their guest are solely responsible for all other meals and expenses not specifically set forth herein.
· Airline tickets once issued are non-transferable (i.e. no name changes allowed). Any alterations to confirmed flights and/or accommodation details will be at the expense of the winner. All components of the Prize must be fulfilled at the same time and they cannot be split across different time periods.
· Individual supplier terms and conditions apply.
· Flights: Flights are economy class and may be indirect. The airline’s Conditions of Carriage apply to all flights. The Winner and travelling companions must travel at the same time and are responsible for transport from their residence to their nearest Capital City Airport in Australia.
· Airline, flight route and dates of travel are subject to the promoter’s absolute and final decision.
· Any changes to the prize package made by the winner can be discussed with the Promotor and confirmed in writing prior to being actioned. Any changes to the package will be subject to a $250 AUD + GST administration fee.
The following are not included as part of the prize: all other out-of-pocket expenses including additional meals, beverages, laundry services, spending money, additional accommodation due to flight schedule changes, optional excursions, tipping, passports, visas, travel insurance and all other ancillary costs not expressly listed as provided in the prize detail above. The costs of obtaining any of these requirements are the responsibility of the prize winner and their travel companion. The Promotor recommends the Winner obtains travel insurance to mitigate any of the travel associated costs that they may incur.
The winner of the prize must take the prize as described and, on the conditions, stated in these Terms, and the prize cannot be used in conjunction with any other offer.
General
Without limiting the above, the winner(s) agree to participate in all promotional activity (such as publicity and photography) in connection with the Promotion and/ or the winning of the Prize (as reasonably requested by MFW) free of charge, and agree to sign any additional documents reasonably required by MFW to give effect to this condition. Subject to law, the winner(s) must consent to using their names, likeness, images and/or voices (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), or undertaking the Prize.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence).
The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If a winner of the Prize is under the age of 18 years, the Prize will be forfeited by that entrant, and a redraw will occur as the competition is only open to Entrants 18 years and over
In the event of war, terrorism, state of emergency, disaster or Covid-19 or any other force majeure event the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize. The Promoter reserves the right to modify, suspend or terminate the Promotion without notice.
By accepting the prize, the winner and their guests give permission to the Promoter to document their image and use that documentation in promotional campaigns including but not limited to social media, email, editorial, advertorial, website content and additional video platforms.
As a condition of entering the Promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
As a condition of accepting the Prize, each winner must sign any legal documentation in the form required by the Promoter, and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; death or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an reasonable period, unless otherwise advised, use this information, and disclose this information to third parties, including but not limited to Midas Shoes and MFW for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct personal information to the Promoter.
